User agreement

It is the user's responsibility to provide correct information when ordering from Frágangur, whether about themselves or about the other parties to the vehicle transaction. The user warrants that the information is correct and complete. Frágangur may halt document processing and demand further information from the user if Frágangur has reason to believe that a vehicle transaction is being carried out contrary to these terms or to Icelandic law.

Frágangur reserves the right to refuse any order for document processing without giving a reason. By accepting these terms the user authorises Frágangur to request whatever information Frágangur considers necessary to protect the security of the service, of its users and/or of third parties. That may take the form of questions to the user or a demand for confirmation of information they have given.

All use of Frágangur is at the user's own risk. If a dispute or a loss arises from the use of Frágangur, or from the vehicle transaction carried out through it, that is entirely unrelated to the owners of Bílafrágangur ehf. and is not their responsibility. The user cannot claim damages or refunds of any kind from Frágangur on account of incorrect information the user may have given when ordering document processing.

Frágangur is the controller for the processing of data, as defined in the Icelandic data protection act and in the European Union's GDPR, and processing of personal data is fair and transparent. The user may contact Frágangur at any time to request access to the information Frágangur holds about them, to correct it, to erase it, or to exercise any other right provided for under applicable data protection law.

To order from Frágangur, the user must provide the ID numbers, names, telephone numbers and email addresses of the parties to the vehicle transaction, as well as the addresses of the buyer and the seller. Frágangur follows Icelandic law on the handling of personal data and takes the utmost care with it. When a buyer applies for a car loan or a finance agreement through Frágangur, information about the buyer is shared with the lender they chose during the order process. The information is not used for any other purpose.

A change in the ownership of Frágangur does not affect the user's rights or obligations, and the service will continue unchanged regardless of such a change unless the user is notified otherwise with reasonable notice.

Where a demonstrable mistake has been made by Frágangur, that mistake will be corrected as soon as possible.

The user has access to the terms in force on Frágangur's website, www.fragangur.is. Frágangur may amend the provisions of these terms unilaterally. The user accepts the above methods of being informed. The user accepts the terms in force each time a new order is placed with Frágangur. Frágangur reserves the right to communicate with its users by SMS and by email. Frágangur will only send users information concerning the company's service, and not unsolicited material from third parties.

Any case arising from the use of Frágangur shall, unless otherwise agreed, be governed by Icelandic law. Proceedings over a breach of these terms or a dispute about their interpretation may be brought before the District Court of Reykjavík.

These terms are issued by Frágangur and are in force from 15 April 2020 until new terms take effect.
